1. Introduction

The terms contained in this document (the “Promotional Terms”) apply to all promotional offers available on Bjerrely Fiskesø (Please refer to the company information mentioned above) and together with any applicable specific promotional terms, which may also be referred to as (“Special Promotion”).

The present Promotional Terms and any Special Promotional Terms, as published from time to time, form an integral part of Bjerrely Fiskesø Terms and Conditions. Therefore, by participating in any Promotion, you accept and agree to be bound by Bjerrely Fiskesø Terms and Conditions.

Bjerrely Fiskesø is committed to making sure that its Fishermans are acting responsibly and safely and that all Promotions and products offered by Bjerrely Fiskesø are used in a responsible manner. If we believe that a Fisherman is experiencing harm or is vulnerable, Bjerrely Fiskesø reserves the right to cease offering a Promotion and will contact the Fishermans to ensure that they are fishing safely. We will routinely carry out welfare checks, especially if you are fishing for long periods, but please take the time to consider whether you may need assistance and contact us immediately, either at our physical facilities or by phone.

In the event of any conflict or inconsistency between these Promotional Terms, any applicable Special Promotional Terms, and the Terms and Conditions, the Special Promotional Terms shall prevail, followed by these Promotional Terms, and our Terms and Conditions, but only to the extent necessary to resolve such conflict or inconsistency.

2. Types of Promotions

Bjerrely Fiskesø offers a variety of promotions, Jackpots, and tournaments to the Fishermans in relation to recreational activities on the premises, or any other related product we may offer time by time. Our Promotions may include:

  • Jackpots: it is a specific extra fish indicated on the Bjerrely Fiskesø fishing board and Bjerrely Fiskesø social networks. Only the listed fish will be eligible for the jackpot. The jackpot will start at 100DKK and will increase daily by 100DK. The fisherman who catches the indicated fish will be considered the winner of the prize. The Fisherman must fight and land his own fish, with no assistance from others except by one fishing net assistant. At Bjerrely Fiskesø we offer Jackpots for free and Jackpots upon deposit, as detailed in each case.
  • Jackpot Day: in the absence of a Jackpot winner within a specified time. Bjerrely Fiskesø may call a Jackpot Day where the prize will be won by the fisherman who caught the heaviest fish. At Bjerrely Fiskesø we offer Jackpot Days for free and Jackpot Days upon deposit, as detailed in each case.

3. Conditions for being eligible for a Promotion

To be eligible for a Promotion, the Fisherman shall fulfill the following conditions

  1. Pay the participation fee determined to the specific event. (if apply)
  2. Be the holder of a valid Bjerrely Fiskesø fishing permit, paid for the period in which he/she will be using the facilities. Once the fishing permit expires, the promotion will no longer be in effect.
  3. Be over 18 years of age
  4. Keep the data on the fishing permit accurate.
  5. Accept and comply with Bjerrely Fiskesø Terms and Conditions, as well as, with these Promotional Terms, and any Special Terms.

4. Reservations / Cancellations

Bjerrely Fiskesø reserves the right to stop any Fisherman activity and to cancel any Promotion in accordance with the below Section 5. Bjerrely Fiskesø further reserves the right to refuse any payout and/or to cancel any winnings if it appears that a Fisherman is in breach of Section 5.

Bjerrely Fiskesø is not obliged to offer Promotions and does so at its sole discretion.

The Promotions offered to the Fishermans are intended for personal use and may not be assigned, in whole or in part, to any other Fisherman and/or third party. Fishermans may not share Promotions with other Fishermans.

Bjerrely Fiskesø Promotions are optional, and Fishermans may decline to participate in, any or all Promotions.

5. Promotion Abuse Policy

Promotions are awarded to reward valued Fishermans to enhance their enjoyment at Bjerrely Fiskesø. We operate a zero-tolerance approach to all forms of Promotion abuse, and any other kind of fraudulent activity. Therefore, your use of any Promotion is subject to our review, and we reserve the right to take the following action against Fishermans who have breached our Terms and Conditions, including breach of these Promotional Terms and Conditions:

  1. Block access to any Promotion
  2. Remove or cancel any Promotion and/or pending Promotion
  3. Void or revoke any associated winnings made through the Promotion
  4. Void or revoke the Fisherman fishing permit, at our own discretion.

The determination of what constitutes a Promotion abuse will be at Bjerrely Fiskesø sole discretion, and includes but is not limited to the following:

  1. Using more fishing rods than declared on the fishing permit
  2. Registering more than once to take advantage of a Promotion
  3. Using the same Bonus and/or Boucher more than once.
  4. Executing any of the above as part of a group or any other form of collusion.

6. No Warranty, Limitation of Liability

Bjerrely Fiskesø shall not be liable for technical, hardware, or software failures of any kind or lost or unavailable conditions which may limit or prohibit the ability to enter or participate in any Promotion. We shall not be liable for any damages or loss resulting from claimed Promotions.

 

We reserve the right to change or cancel any Promotions, including but not limited to, in the following reasons:

 

  1. Legal or regulatory requirements
  2. Security
  3. Abuse or breach of our Terms and Conditions
  4. Unavoidable circumstances
  5. Human error
  6. Promotion abuse (please see Section 5 Promotional Abuse Policy)
  7. Other valid reasons determined in our sole discretion

We reserve the right to refuse or void a Promotion and related winnings in the event of your deposits being canceled or denied by any payment service or payment provider related to you or in the event of chargebacks.

7. Jackpot

The following terms and conditions will apply to all Jackpots granted by Bjerrely Fiskesø.

 

  1. Jackpots may be offered from time to time, at Bjerrely Fiskesø sole discretion.
  2. The number of Jackpots may vary, at the sole discretion of Bjerrely Fiskesø as specified in the Special Promotional Terms.
  3. The amount of the jackpot will be determined at Bjerrely Fiskesø’s sole discretion.
  4. All Jackpots granted will be made available for a limited period of time and available to claim until a specific date.
  5. Jackpots can only be won on a specific fish as determined by Bjerrely Fiskesø, in his sole discretion.
  6. A winner must fight and land the fish, with no assistance from others except by one fishing net assistant.
  7. In the event that the fish is caught by a child under 12 years of age, Bjerrely will deposit a new fish in its replacement.
  8. In the case of a dispute, the Bjerrely Fiskesø’s decision is final.
  9. The Jackpot obtained at the Bjerrely Fiskesø facilities shall be credited to the winner by Mobile Pay or Bank deposit, determined by Bjerrely Fiskesø, in its sole discretion.
  10. To benefit from a jackpot, you must notify the Bjerrely Fiskesø team and claim the jackpot up to 30 minutes after the required fish has been caught.
  11. The maximum Jackpot winnings amount that can be transferred to the Fisherman’s is 10.000,00 DKK.
  12. We reserve the right to cancel any granted Jackpots if, in Bjerrely Fiskesø’s sole discretion, we consider there has been an abuse, manipulation, or fraudulent or irregular use of the Jackpots. Any such behavior and/or activity will be considered as an abuse subject to the terms of Section 5 and result in the cancellation of the Jackpots, any Jackpot balance, and may result in the permanent expulsion of the involved from the facilities, at Bjerrely Fiskesø’s sole discretion.

The present Terms and Conditions shall apply to all Jackpots granted by Bjerrely Fiskesø, except as otherwise set out in the relevant Special Promotional Terms.

8. Jackpot Day

The following terms and conditions will apply to all Jackpot Days granted by Bjerrely Fiskesø.

 

  1. Jackpot Days may be offered from time to time, at Bjerrely Fiskesø sole discretion.
  2. The number of Jackpot Days may vary, at the sole discretion of Bjerrely Fiskesø as specified in the Special Promotional Terms.
  3. The amount of the jackpot will be determined at Bjerrely Fiskesø’s sole discretion.
  4. All Jackpots granted will be made available for a limited period of time and available to claim until a specific date.
  5. The prize will be won by the fisherman who caught the heaviest fish.
  6. Jackpots can only be won on a specific type of fish as determined by Bjerrely Fiskesø, in his sole discretion.
  7. All fish in contention will be weighed on the scales disposed by Bjerrely Fiskesø.
  8. A winner must fight and land his own fish, with no assistance from others except by one fishing net assistant.
  9. In the case of a dispute the Bjerrely Fiskesø’s decision is final.
  10. The Jackpot obtained at the Bjerrely Fiskesø facilities shall be credited to the winner by Mobile Pay or Bank deposit, determined by Bjerrely Fiskesø, in its sole discretion.
  11. The maximum Jackpot winnings amount that can be transferred to the Fisherman’s is 10.000,00 DKK.
  12. We reserve the right to cancel any granted Jackpots if, in Bjerrely Fiskesø’s sole discretion, we consider there has been an abuse, manipulation, or fraudulent or irregular use of the Jackpots.
